>> they were trying to save her life. >> she was dying. >> oh my gosh. it's unbelievable. it's very horrible. >> reporter: the victim, an adult white woman died in the middle of connecticut avenue as the search continued for her killer. >> looks like she didn't have any shoes on her. looks like she was hanging with a bad crowd, bad people maybe. >> reporter: that person is believed to be 51-year-old joseph. police spent the afternoon searching for him. they recovered the van, so they believe he is traveling on foot. armed and dangerous, and he has the track record to prove it. he has had nine restraining orders against him since 2004. he has two open cases in montgomery county. domestic violence and an on going divorce case filed in december. police are still investigating if there's any connection between those cases and the tragedy that took place today. >> everything points to the fact that this was not a random

act. so my guess is, with everything we know right now, the victim and the suspect were likely known to one another so this was not a random incident. >> reporter: just a few minutes ago, we spoke with a man who says he is friends with the suspect. even saw him after the shooting. this man says that the suspect came to his mechanic shop and told him that he had done something terribly wrong and that police were looking for him. back to you. >> what is clear, kristen, is something terrible happened at that intersection this morning. thank you. derek. lesli, 9 wants you to know the man at the center of the investigation selling alcohol to minors made his first court appearance today. the owner of the town square market was in court arraigned on criminal charges in d.c. superior court. our own andrea mccarren has been following this story. and for you, is personal. >> well, it was another really

surprising day in court, derek. not for what happened inside richard kim's arraignment, but for what he said to us afterward. >> trouble. why -- >> a subdued town square market owner arrived at d.c. superior court to face criminal charges. >> despite the ire of his family, kim said he made a mistake, by standing in a d.c. superior courtroom to plead not guilty to charges of supplying alcohol to a minor. >> did they not look young to you? >> sometimes -- >> we asked his koreaen friend to serve as our translator. >> sometimes you sell to 16- year-olds. >> look 16 and when you see id, it's different. it's over age. >> the last time we came face to face with the owner of town

square market, he was defiant. we documented his store's allegedly cor sales to minors for weeks. evidence backed up by 40 police citations. he said he was filled with remorse. what does mr. kim say to the parents of the children who bought alcohol from him? >> i'm sorry. i feel very sorry. i am sorry. >> richard kim will be back at d.c. superior court on april 17 and coming up tonight at 6:00, derek, we will hear what the koreaen immigrant wants to do next with his northwest washington store. another unexpected comment from him. >> anything on what happens to this liquor license. >> great question. his license is up for renewal on april 30, just about six weeks away. that is a separate, but parallel investigation that is being handled by d. c.'s liquor control board.

>> thanks, back to you. an emotional and scary morning for a mom after the car was carjacked out of their garage. the car was stolen on suitland road in southeast and recovered in capital heights. delia was there for the emotional reunion. this morning's frightening ordeal came to an end, a happy end, when the baby was safely returned to his family and his home here in southeast. five month old, the one, safe in his mother's arms after a carjacking suspect ripped him from the family's home in southeast. >> i got the phone call. i was at work and i tried to get back as quick as i could. i was a lot of anxiety. >> the worst feeling. you know you live in a community where things like this happen, but you are like, wow, it actually happened to me. >> the baby's aunt says the garage door was open. the car was running.

after mom loaded the five month old in his car seat, she returned to the house to retrieve the second child. >> stepped inside for two seconds. she wasn't inside the house yet and the car is in the garage and somebody, you know, jumps in the car and she is actually opening up the door to go in the house to grab my son standing at the door and peels out of the garage. >> reporter: the car was located a half an hour later on rail street in capital heights. one mile away. the little boy unharmed. canines were called in to search for the suspect who fled on foot. >> by the grace of god, we have our nephew, my sister has her son back. >> it will take some time for all of this to sink in. but the dad tells me he is thankful that the family is back together again. in southeast, delia oregon .

26-year-old maurice was sentenced after pleading guilty to five arsons over a 3 1/2 year span. half a dozen firefighters were injured battling one of those fires in the district last april and one was in the hospital for two months. several firefighters were there when his sentence was handed down. new information tonight about a well known montgomery county teacher and coach accused of having sex with a 16- year-old girl. one day after having criminal charges against him dropped on a technicality, scott speier met with school officials. scott broom reports from montgomery county school headquarters where speier and his lawyers say they intend to fight for his job. >> scott speier appeared here before school officials in rockville only a day after prosecutors dropped charges against him because they say there's a flaw in the law. not because they believe he's innocent of having sex with a

16-year-old former student. prosecutors have called the flaw in the law ridiculous. but for speier, it's open the door today to an appeal for his job back. appearing with the support of his brother and saying nothing to reporters. preferring to let his lawyer do the talking. >> why does he want his job back? >> because it's been his life. teaching and coaching has been his career. and he's had a wonderful career. he is such a devoted teacher. that anything too devoted and maybe that's part of the reason we have the problem we do here. >> reporter: speier was accused of having sex with a 16- year-old former student, but prosecutors hands were tied because they said, she's old enough to consent to sex and speier's volunteer status as a track coach where the girl is an athlete lets him off the hook. under a flawed state law. speier's lawyer chooses his words carefully. >> he continues to maintain he

has done nothing inappropriate with any student or athlete at any time. >> reporter: it's now up to montgomery county school officials to conduct an investigation and confront speier with evidence before firing him. in the meantime, speier does remain suspended from his job as an 8th grade social studies teacher and from volunteering as a coach in any county school. in rockville, scott broom, 9news now. >> montgomery county schools has issued a written statement saying they will take appropriate action only after an investigation and it's not clear how long that will take. you know, you may have gone outside and felt an unusual thing, a drop of sweat on your forehead. it was almost 80 degrees out there. top, it's crazy like may today. >> it really is. we did hit 80. we backed off a little. we did hit 80 once today. is that record high? not quite.

record high was 87 in 1987. they were all records and actually brought out the cherry blossoms on the 15th of march. that was the earliest ever. let me show you temperatures. still warm up in new york. 73. cool in providence. we are 78. it's warm just about everywhere. 72 in pittsburgh. not record warmth, but about 15 to 20 degrees above average. 66 in cleveland. and 73 right now in columbus and 75 in charleston. closer to home, 81 in manassas. 82 in culpeper. 81 in fredericksburg. and 77 in gaithersburg and also at andrews. now satellite picture, radar combined, here are the showers. a couple showers still possible south of town. we'll come back and talk more about the potential for a shower or thunderstorm and take you on through the week into the weekend and let you know if the warm air can last through into next week. >> thank you, top. all this unusually warm weather just might coax a few cherry blossoms out of hiding earlier than expected. the national park service

recently updated the cherry blossom forecast to march 24 through the 28th. anny hong with more on whether they might come sooner. >> everyone is watching these cherry trees along the title basin closely. while they aren't blossoming yet, they are definitely budding. and with this unusually warm weather we're having, it's putting these trees on a faster track for a peek bloom. it's fantastic. i come down here to walk all the time and it's just, i mean, it's the greatest place you can come. >> mild winter in this week's temperature that bring out shorts and tank tops are fueling fast growth for the nearly 2,000 cherry trees along the title basin. it's putting them ahead of the average peek bloom date of april 4. arborist, the national park service forecast a peek bloom sometime during march 24 to the 28th. >> it's precisely because of mother nature. >> peek bloom is when 70% of the blossoms are open.

the blooming period is expected to begin next tuesday, march 20, and can last as long as 14 days. >> the whole title basin is rimmed with these pink really soft flowers and the water and, you know, the sky. just gorgeous. >> so how long will these cherry blossoms be around for? it depends on the wind. that is their main enemy. along the title basin in southwest d.c., i'm anny hong, 9news now. >> arborists can give better forecasts no more than ten days out and they will announce any other updates through their website. anita. the polls are open in the deep south where voters in alabama and mississippi are casting ballots in today's republican presidential primaries. it could be a make or break night for newt gingrich. he needs good showings in south to keep his campaign afloat. the longer gingrich stays in, the more delegates he costs rick santorum. claiming to be the true

tonight, president obama is promising a full investigation into the murder of 16 afghan citizens allegedly at the hands of a u.s. soldier. >> danielle nottingham is at the white house where the president says the shooting will not change the u.s. commitment in afghanistan >> reporter: anita, from the white house rose garden, president obama is heartbroken over the murder of innocent people and that the u.s. will stick to its strategy to end the war responsibly. chanting death to america, protesters in afghanistan burned an effigy of president obama. they are demanding a public trial for the u.s. soldier accused of killing 16 people, including women and children. the soldier, a 38-year-old father of two is in custody. president obama assured the afghan people there will be justice in this case. >> killing of innocent civilians is outrageous and

it's unacceptable. it's not who we are as a country and it does not represent our military. >> the taliban has promised revenge. tuesday, militants opened fire on a government delegation attending a memorial service for the victims. an afghan soldier was killed. the u.s. is pulling 23,000 soldiers out of afghanistan by september. it's part of the obama administration's plan to get most troops out by 2014. the "new york times" is reporting that the white house is considering speeding up the withdrawal. >> i do not believe that there is any reason at this point to make any changes with regards to our strategy and for the process of drawing down. >> this is the third time this year the u.s. has infuriated the afghan people. last month, six americans were killed after the koran was burned at a u.s. military base.

and in january, video surfaced of marines urinating on the bodies of taliban fighters. >> by the end of the summer, the u.s. plans to leave behind 68,000 troops in afghanistan. at the white house, danielle nottingham, now back to you, anita. >> thank you so much. secretary of defense, pinetta, says the soldier could face the death penalty. closing arguments are underway in a former rutgers student. he is accused of spying on his college roommate. his attorney told the jury today that his client was acting like a kid, not a criminal when his web cam captured his gay roommate kissing another man and he set up the web cam because he was afraid someone might steal his ipad. prosecutors argued he had something different in mind. >> the whole incident, not what they were doing sexually.

we have a commuter alert for beltway drivers in northern virginia. be ready for over night detours around the springfield mixing bowl due to the hot lanes project. here's the deal. the inner loop will be closed at the mixing bowl from 9:00 p.m. through 5:00 a.m. that's every night starting tonight through thursday night. then again on friday night from 9:00 p.m. to 7:00 a.m. saturday morning. drivers will be detoured so crews can demolish an old ramp over the highway. >> you might want to expect a bumpy ride if you drive through adams morgan.

ironically, walking in the area could also be pretty difficult while the construction is going on and finding a parking spot, you know it's never easy. it's going to get harder. the makeover is expected by sometime early in the summer. lesli. >> jetting off for a summer breeze may be cheaper if southwest airlines gets its way. the discount flier is asking the department of transportation for permission to offer nonstop service from reagan national airport to austin texas. southwest wants to provide one stop service to san diego from austin. if it gets the go ahead, the flights could take off by the summer. you filed your taxes, now you want to know when you'll get your money. it's called irs to go and it's free for your apple or android smart phone. it has to put in your social security number. you can check the status online at irs.gov. coming up on 9news now.

people have had a bad experience or two with a salesman or sales woman, but it's hard to imagine anything worse than what a woman experienced yesterday in montgomery county. >> you see that woman told us, what began as grumbling led to an insult so bad, we had to send matt jablow out there to investigate. >> i was driving up to d.c. >> shanay lewis got more than she bargained for when she bought a $20 cassette adapter. >> unbelievable. >> according to her, the problem began as she was paying for the adapter when this radio shack salesman told her about the 5-cent bag tax in montgomery county. a tax she had never heard of and she lives in baltimore. >> i'm like 5 cents, i just paid sales tax. it's 5 cents for a bag. he said yeah. this is montgomery county. >> after going back and forth with the salesman over the 5- cent bag tax, she decided to forget the whole thing and get her money back.

the store took an extremely unusual and disturbing turn. >> when the salesman gave her back her money, he gave her the receipt. at the bottom of which, he typed in, ugly u.s.a. tattooville, maryland. >> obviously he was talking about me. >> the salesman claimed he was only kidding. clearly she didn't and doesn't think it was funny. >> i was shocked more so than anything. >> manager kicked us out when we asked for an explanation of what happened. and shanay says he wouldn't talk to her either. >> the manager didn't want anything to do with it. >> she is in touch with the corporate office in hopes of getting the salesman fired. she says her days of shopping as radio shack are over. >> i want nothing to do with radio shack ever again. >> matt jablow, 9news now. >> hard to blame her. earlier, we did get a response. in reads in part, this incident

does not meet radio shack's expectations for customer service and radio shack responded immediately after seeing reports in the media taking this strongest possible disciplinary action. radio shack also did contact shanay lewis, offered her a gift certificate and told her that they fired that salesman. today the judge in the penn state sex abuse scandal rejected a request from jerry sandusky's lawyer for more details about the allegations against his client. that request included when and where the alleged crimes took place, but the judge says the prosecutors don't have additional details. so now sandusky's attorney says he'll go to court next week to ask that all child sex abuse charges against his client be dismissed. sandusky is accused of ten boys over 15 years. he denies all the allegations. the defense is now rested in the virginia tech wrongful death lawsuit trial. the parents of two of the massacre victims, one of them

lawmakers, as he left the meeting. security and other north koreaen delegates pushed the south koreaen lawmakers away. the incident comes amid reports that china is returning north koreaens to their homeland instead of letting them defect the south. a financially strapped little league in southern california needed cash to save its season. so, a local strip club stepped in to help. >> this particular gentleman's club is near the ball park and they donated $1200. not everybody is so happy once the parents and the league found out where the cash came from. >> you know, whoever is willing to get behind the kids in a positive way. we have to be willing to support those people as well. >> we do not want -- i think for us, if we do need the money. but we will go some over avenue. >> really? the league president says he has given the check back and he's going to try to renegotiate some fees for the ballpark. the club says it has been active in the community and has

tonight, some of the strongest research to date on why we all need to avoid eating too much red meat. this team at harvard tracked more than 120,000 men and women over twenty years and they found eating unprocessed red meat every day, stuff like hamburgers or roast beef was associated with a 13% higher risk of dying young, from a variety of causes. heart disease, cancer. now if the meat is processed, bacon, solomi. that risk jumps to 20%. the findings don't surprise nutrition experts that say serving sizes of red meat need to be kept in check. >> 2/3 of your whole grains, beans, fruits and vegetables and 1/3 of that to be your

animal protein. >> that's danielle with the cancer treatment centers of america. she says switch up those protein sources with fish, poultry, nuts and beans. here's the goal, reduce red meat consumption to less than 2 to 3 servings a week and stick to that. 9 wants you to know a sobering statistic. in the state of maryland, an estimated 30,000 adolescents need treatment for drug and alcohol and they are not getting it. >> what is a parent to do to uncover a potential problem and find some help? andrea mccarren turned to a drug and alcohol counselor for some answers. >> i think the under reported story is actually the kids who have regular or daily use. >> parents who facilitate that use, by providing alcohol, drugs, or a place to party are committing a serious crime. >> neither child neglect or child abuse.

>> and if you thought adolescent substance abuse couldn't happen in your family, consider this. he says affluent suburban washington sends more teenagers to treatment programs than any other place in the country. many cost $1,000 a day. >> it's never appropriate for a 15-year-old to be drinking with their friends on a friday night. that's not appropriate. that is the problem. parents who are thinking, well that's normal adolescent behavior. >> he has a warning for parents. do not become your child's unintentional supplier. >> lock your liquor cabinet. lock your medicine cabinet. >> as clinical director of path ways, brody says the teenagers whose parents set the clearest expectations tend to do best. >> drug use is not negotiable. alcohol use is not negotiable. it doesn't happen in our house. if you come home and think you are smelling like alcohol,

we're going to breathalize you. andrea mccarren, 9news now. here are some more alarming statistics related to just montgomery county. as many as 8% of all students have a diagnoseable substance abuse problem. the bigger problem is that only 10% of those young people get the help they need. 4% of montgomery county students reported being in the car with a drunk driver this school year and that is thousands of kids. top. you know, i think we were out here a little while ago. it's warmer now. >> actually, it is. it's back up to 81. 82 in college park. pretty nice. let's start with a live look outside. there are a couple of showers and storms. but right now, live look at the capital brought to you by michael and son. but temperatures are un-- it's like late march. 78. our average high is 56. winds out of the west at 5. dew

point is 50 and pressure rising over the past hour, 29.98 inches of mercury. relative humidity only 37%. here's a look at the radar. most of the showers, few and far between, are south of 66. got one just north of fredericks and one that went through prince georges county that is headed towards southern anne arundel and look at that with live doppler 9,000. i thought it might have had hail in it earlier. it does have heavy rain and pretty good wind. crossing 4, and it's headed toward deal and shady side as it gets into anne arundel county. where will it go in the next hour? it runs pretty much due eastward. the good news, it loses some of its punch as it rolls eastward. temperatures 80 in rockville. 80 in great falls. 78 in arlington. 82 in college park. and 79 in beltsville. so, it stays warm all week. early thunderstorm possible tonight. just spectacular tomorrow. you'll need your shades.

all this week, we have been counting down to saturday's rock and roll u.s.a. marathon and profiling just some of the 21,000 runners who are going to take part. several veterans are running to help returning veterans cope with post-traumatic stress disorder. as andre yay andrea roane shows us, they hope to make homecomings less painful. >> matt is one of the lucky

ones, a navy chopper pilot who flies to sea, but hasn't suffered the emotional combat scars so many servicemen carry home from war. >> most of the people i know that had issues don't talk about it. they suffer alone. they found out a little later after something has happened to drive them to seek help. >> that's why matt and his wife are running this rock and roll marathon. raising money for not alone. a group helping servicemen and women and their families overcome ptsd. >> my husband came back from war and suffered with it. i don't know if he knew about it at the time. we weren't that familiar with it. it will be a nice play to go. >> greg and his wife joining the not alone team, grateful this tour of duty keeps them home with their family and hoping the money they raise helps their struggling friends and colleagues. >> i don't know how you put
